At Big Tyre we are committed to serving you in the best way possible. However, occasionally things just do not go the way they are meant to. These Terms and Conditions explain how orders, returns, warranties and other issues are handled. Nothing in these Terms and Conditions is intended to exclude, restrict or modify any rights you may have under the Australian Consumer Law or any other law that cannot be excluded.

These Terms and Conditions apply to all Big Tyre sales and supplies, whether made through our website, by quote or invoice, by email or telephone, in store, through an account arrangement, or otherwise.

1. General and Definitions

1.1. When we refer to "Big Tyre", "we", "us" or "our", we mean Big Tyre Pty Ltd (ABN 32 101 069 630).

1.2. When we refer to "you", "your" or "customer", we mean the person or entity that uses our website, requests a quote, places an order, accepts a quote, pays an invoice or purchases goods or services from us.

1.3. In these Terms and Conditions:

  • "ACL" means the Australian Consumer Law set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth);
  • "goods" or "products" includes tyres, wheels, rubber tracks, retreaded products, rebuilt products, special order products, custom products and any other products supplied by Big Tyre;
  • "services" includes any fitting, installation, repair, retreading, rebuilding, modification, commissioning or other services supplied by Big Tyre, where applicable;
  • "special order" means a product ordered, imported, sourced, manufactured, rebuilt, retreaded, modified or processed specifically for you;
  • "custom product" means a product made, modified, configured or processed to your specifications or requirements;
  • "retreaded product" means a product retreaded by or for Big Tyre; and
  • "rebuilt product" means a product rebuilt, repaired or reconditioned by or for Big Tyre.

1.4. By placing an order, accepting a quote, paying an invoice, creating an account, using our website or purchasing from us, you agree to these Terms and Conditions.

1.5. These Terms and Conditions apply despite anything stated in a purchase order, request for quote, email, customer document or other document issued by you, unless Big Tyre expressly agrees otherwise in writing.

1.6. If you place an order, accept a quote or give instructions on behalf of a business, company, partnership, trust or other entity, you warrant that you are authorised to do so on behalf of that respective entity.

1.7. Any variation to these Terms and Conditions must be agreed by Big Tyre in writing. Big Tyre may update these Terms and Conditions from time to time. The version that applies to a transaction is the version in effect when Big Tyre accepts the relevant order, unless Big Tyre agrees otherwise in writing.

2. Orders, Quotes and Purchasing

2.1. Submitting an online order, quote request, purchase request or other order is an offer to purchase the relevant goods or services. It is not, by itself, a binding contract requiring Big Tyre to supply the goods or services.

2.2. Big Tyre is not bound to supply goods or services until it accepts your order. Acceptance may occur when Big Tyre confirms the order, issues an invoice, receives payment, confirms stock, dispatches or supplies the goods, commences the services, or otherwise confirms acceptance in writing. Any automated website email or order acknowledgement is an acknowledgement only, unless it expressly states that Big Tyre has accepted the order.

2.3. Unless stated otherwise in writing, any quote provided by Big Tyre is valid for 7 days from the date of the quote and is subject to stock availability, supplier pricing and confirmation by Big Tyre.

2.4. Big Tyre may cancel, decline or refuse an order where:

  • stock is unavailable or supplier availability changes;
  • a product has been discontinued;
  • there is a pricing, stock, website, product information, supplier data or system error;
  • payment is not received, is reversed, is dishonoured or does not clear;
  • you provide incomplete, incorrect or misleading information;
  • the goods or services cannot reasonably be supplied; or
  • Big Tyre otherwise has a reasonable basis for not fulfilling the order.

2.5. Where permitted by law, Big Tyre may cancel or decline an order even if an invoice has been issued or payment has been received, including where a circumstance in clause 2.4 applies.

2.6. If Big Tyre cancels an order after payment has been received, Big Tyre will refund the amount paid for the cancelled goods or services. This does not prevent Big Tyre from deducting any amount that it is lawfully entitled to deduct where you cancel or change an order after Big Tyre has incurred costs.

2.7. If you wish to cancel an order:

  • standard stocked products may usually be cancelled before they have been dispatched, collected, fitted, installed, ordered from a supplier or otherwise actioned;
  • special orders, imported products, retreaded products, rebuilt products, custom products and products ordered specifically for you may not be able to be cancelled once actioned; and
  • Big Tyre may deduct or charge reasonable costs incurred because of the cancellation, including supplier charges, freight, import costs, handling charges and restocking charges.

3. Prices, Payment and Product Information

3.1. Unless stated otherwise, prices are in Australian dollars and include GST.

3.2. Delivery, freight, fitting, installation, insurance, customs, duties, taxes or other charges may be additional and will be shown at checkout, in a quote, in an order confirmation or in an invoice where applicable.

3.3. Accepted payment methods are those made available at checkout, stated in a quote or invoice, or otherwise agreed by Big Tyre.

3.4. Big Tyre may withhold supply, dispatch, collection or performance of services until payment has cleared, unless Big Tyre has approved credit terms in writing.

3.5. Account customers must pay invoices in accordance with their approved account terms or any other payment terms stated by Big Tyre.

3.6. If an amount is overdue, Big Tyre may suspend or refuse further supply until the overdue amount is paid. Big Tyre may also recover reasonable costs of recovering overdue amounts, to the extent permitted by law.

3.7. Big Tyre may correct pricing, product information, stock level, image, specification, website, system or supplier data errors. If an error affects your order, Big Tyre may cancel the order and refund amounts paid for the affected goods or services, or invite you to proceed on corrected terms.

3.8. Product images are for illustration only. Actual products may differ from images, including as to appearance, tread pattern, branding, packaging or minor specifications.

3.9. You are responsible for checking the size, type, rating, specification, application and suitability of the goods before ordering. Big Tyre may rely on information you provide. To the extent permitted by law, Big Tyre is not responsible for a product being unsuitable where that unsuitability results from incomplete, incorrect or misleading information provided by you, or from you ordering the wrong size, type, rating or specification.

3.10. Nothing in clause 3.9 limits any rights you may have under the ACL where you make a particular purpose known to Big Tyre and rely on Big Tyre's skill or judgement in circumstances where the ACL applies.

3.11. Products advertised online are subject to availability. Stock levels may not update in real time, and some products may be sourced from suppliers, imported, manufactured, rebuilt, retreaded or specially ordered.

3.12. If an ordered product is unavailable, Big Tyre may offer you an alternative product. You may accept or decline that alternative product.

4. Delivery, Collection, Freight, Title and Risk

4.1.      Depending on the goods or services and your location, Big Tyre may offer collection, delivery, freight, dispatch from a supplier, fitting, installation or other arrangements.

4.2.      Delivery and freight times are estimates only unless Big Tyre expressly agrees in writing that a time is guaranteed.

4.3.      You must ensure that the delivery location is safe and accessible and that appropriate equipment and personnel are available to unload, move and receive large or heavy goods.

4.4.      Unless Big Tyre agrees otherwise in writing, risk in goods passes to you when the goods are collected by you, delivered to the delivery address, or handed to a carrier for delivery to you, whichever occurs first.

4.5.      Ownership of goods does not pass to you until Big Tyre has received cleared payment in full for those goods and any related services, unless Big Tyre agrees otherwise in writing.

4.6.      If Big Tyre arranges freight at your request, Big Tyre may do so using a carrier or supplier selected by Big Tyre or agreed with you. Freight insurance is only included if Big Tyre expressly confirms this in writing.

4.7.      You should inspect goods promptly on delivery or collection and notify Big Tyre as soon as reasonably possible of any visible damage, incorrect goods or missing items.

5. Returns and Refunds Policy

5.1.      This clause 5 is Big Tyre's return and refund policy. Big Tyre may link to this clause on its website under the heading "Returns and Refunds Policy".

5.2.      Change of mind returns are not automatic. Big Tyre may, at its discretion, accept a change of mind return for standard stocked products if:

  • the return is requested within 7 days of purchase;
  • the product is unused, unfitted, unmounted, undamaged, unaltered and in original condition and packaging where applicable;
  • you provide proof of purchase;
  • the product is still stocked by Big Tyre or its supplier; and
  • Big Tyre approves the return before the product is returned.

5.3.      Change of mind returns will generally not be accepted for:

  • retreaded products;
  • rebuilt products;
  • custom products;
  • special orders;
  • products manufactured, modified, imported, sourced or processed specifically for you;
  • products that have been fitted, mounted, installed, used, damaged, altered or repaired;
  • products no longer stocked by Big Tyre or its supplier; or
  • products correctly supplied by Big Tyre but ordered by you in the wrong size, type, rating, specification or quantity.

5.4.      Where Big Tyre accepts a change of mind return, you are responsible for return freight and any applicable freight insurance. Big Tyre may charge a restocking fee of up to 20% of the product value.

5.5.      Approved refunds will be processed after Big Tyre receives and inspects the returned goods. Refunds will usually be made using the original payment method where possible and may take a reasonable time to process.

5.6.      Freight, delivery, fitting, installation and other service charges are not refundable for change of mind returns unless required by law.

5.7.      Nothing in this clause 5 limits any rights you may have under the ACL or any other law that cannot be excluded, including in relation to faulty goods.

6. Faulty Products, Warranties, Recalls and the Australian Consumer Law

6.1.      If you consider a product purchased from Big Tyre is faulty, defective, damaged or not as ordered, you should contact Big Tyre as soon as reasonably possible and provide:

  • your invoice or order number;
  • photos of the product and the issue;
  • a detailed description of the issue;
  • when the issue was first noticed;
  • how the product has been used and the application for which it was used;
  • whether the product has been fitted, installed, modified, repaired, retreaded, used or damaged; and
  • any other information reasonably required by Big Tyre to assess the claim.

6.2.      Big Tyre may inspect the product, request further information, or refer the claim to a supplier, manufacturer, retreader, rebuilder, carrier or other relevant third party for assessment.

6.3.      Nothing in these Terms and Conditions excludes, restricts or modifies any rights, remedies or guarantees that cannot lawfully be excluded, restricted or modified, including any rights you may have under the ACL.

6.4.      A reference in these Terms and Conditions to the ACL, consumer guarantees or statutory rights does not mean that the ACL applies to a transaction where it would not otherwise apply, and does not give any customer rights beyond those required by law.

6.5.      Manufacturer, supplier or third-party warranties may apply to some products in addition to any rights you may have under the ACL. Big Tyre may assist with warranty claims, but supplier or manufacturer assessment may be required before a warranty outcome can be confirmed.

6.6.      Unless required by law or expressly agreed by Big Tyre in writing, warranties do not cover issues caused by:

  • misuse, abuse, neglect or accidental damage;
  • incorrect fitting, installation, mounting, storage, handling or maintenance;
  • overloading, under-inflation, unsuitable site conditions or unsuitable application;
  • modification, repair or alteration not authorised by Big Tyre;
  • failure to follow manufacturer, supplier or Big Tyre instructions;
  • ordinary wear and tear; or
  • damage caused by road, mine site, agricultural, industrial or operating conditions.

6.7.      The following product category provisions apply subject to the ACL and any non-excludable rights:

  • new third-party products may be subject to manufacturer or supplier warranty terms;
  • imported products may be subject to the terms and assessment processes of the overseas manufacturer or supplier;
  • special orders may not be cancellable or returnable for change of mind once ordered, sourced, manufactured, imported or processed;
  • retreaded products may be assessed by reference to the retreading work performed, the condition of the casing and the way the product has been used;
  • rebuilt products may be assessed by reference to the rebuilding work performed and the way the product has been used;
  • products manufactured or modified by Big Tyre may be assessed by reference to Big Tyre workmanship and materials and the specifications agreed with you; and
  • fitting, installation or other services, where supplied, may be assessed by reference to the services performed by Big Tyre.

6.8.      If Big Tyre accepts a claim, Big Tyre may provide a repair, replacement, refund, credit or other remedy as required by law or otherwise agreed by Big Tyre.

6.9.      If Big Tyre or a supplier or manufacturer notifies you of a product recall or safety issue, you must follow the reasonable recall or safety instructions provided.

7. Advice, Suitability and Customer Responsibilities

7.1.      Big Tyre may provide general product information and assistance. You remain responsible for ensuring that products are suitable for your vehicle, equipment, site, load, use, conditions and requirements.

7.2.      Big Tyre is entitled to rely on information you provide. To the extent permitted by law, Big Tyre is not responsible for unsuitable goods or services where the issue results from incomplete, incorrect or misleading information provided by you.

7.3.      You are responsible for ensuring that goods are used, stored, fitted, installed, maintained and operated safely and in accordance with applicable laws, manufacturer instructions, site requirements and any specifications provided by Big Tyre.

7.4.      Nothing in this clause 7 limits any rights you may have under the ACL where you make a particular purpose known to Big Tyre and rely on Big Tyre's skill or judgement in circumstances where the ACL applies.

8. Website, Privacy and Contact

8.1.      Big Tyre takes reasonable steps to keep website information accurate, but errors may occur in pricing, stock levels, descriptions, images, specifications or availability. Big Tyre may correct errors at any time.

8.2.      Big Tyre does not guarantee that the website will be uninterrupted, error-free, secure or available at all times. Website access may be affected by maintenance, technical issues or events beyond Big Tyre's control.

8.3.      You must not misuse the website, interfere with its security or functionality, or use it for any unlawful purpose.

8.4.      Big Tyre handles personal information in accordance with its Privacy Policy, available on its website.

9. Liability

9.1.      Nothing in these Terms and Conditions excludes, restricts or modifies any liability, right, remedy or guarantee that cannot lawfully be excluded, restricted or modified.

9.2.      To the extent permitted by law, Big Tyre is not liable for indirect or consequential loss, including loss of profit, loss of revenue, loss of production, downtime, equipment downtime, site delays, loss of opportunity or third-party claims.

9.3.      Where you acquire goods or services for business purposes and Big Tyre is permitted by law to limit its liability, Big Tyre's liability is limited, at Big Tyre's option, to one or more of the following:

  • replacement of the goods or supply of equivalent goods;
  • repair of the goods;
  • payment of the cost of replacing the goods or acquiring equivalent goods;
  • payment of the cost of having the goods repaired;
  • resupply of the services;
  • payment of the cost of having the services supplied again; or
  • refund of the price paid for the relevant goods or services.

9.4.      Clause 9.3 does not give any business customer rights that it would not otherwise have under the ACL or any other applicable law. It applies only to the extent that Big Tyre is permitted by law to limit its liability.
